Case Summary of powerful decision from Argentina Supreme Court: Giustiniani v. YPF

last modified Mar 21, 2016 02:25 AM

A summary of the November 10, 2015 judgment of the Argentina Supreme Court of Justice in Giustiniani v. YPF has now been added to our case database, including a link to the decision.

The judges strongly enforced the public's right to access a contract signed by a 51% publicly-owned oil company, YPF. The judges elaborated on the numerous domestic and international obligations Argentina must comply with in protecting the important right to access information. They further asserted that YPF failed to provide sufficient details to prove that they should receive an exemption to protect their trade secrets, and decided that their partner in the contract, Chevron Corporation, should have known in advance that YPF was required to disclose the information sought.
